Motorcycling Under the Influence
Attorneys at the Sacramento law firm Brennan Defense LLP aggressively defend bikers who have been accused of operating a motorcycle while under the influence throughout Sacramento, El Dorado, Placer, and Yolo Counties.
In California, motorcycling under the influence is treated the same as any driving under the influence (DUI) charge. Therefore, if you have been arrested for motorcycling under the influence, you only have ten days after receiving the revocation or suspension order at your arrest in which to file a DMV Administrative Per Se (APS) hearing about your license suspension. If you do not request this hearing, a process to suspend your license will automatically begin. Requesting a hearing means the suspension is postponed pending the outcome at the hearing.
Severe Punishments for Motorcycling Under the Influence
In addition to the administrative license suspension penalties you might face, a DUI conviction carries very serious punishments. Potential punishments for your first conviction depend upon whether you submitted to a breath or blood test at the time of your arrest, but generally include some combination of the following:
- At least 96 hours, but up to ten months, in jail
- Ten month license suspension
- A fine between $390 and $1000
- Mandatory participation in an alcohol awareness program
- Probation
- A license restriction only allowing you to drive to and from work
Subsequent convictions within ten years of the first conviction carry much more severe punishments, including ignition interlock devices being placed on your car, larger fines, more jail time, and a longer license suspension. Punishments are also more severe if you caused an accident, or if someone was injured as a result of your biking under the influence.
