Domestic Violence in California
The California Penal and Family Codes take domestic violence very seriously. Under the Penal Code, you can be accused of committing domestic violence against anyone who is a spouse or former spouse, cohabitant or former cohabitant, anyone with whom you have had a child, or anyone with whom you had or are having a dating or engagement relationship. The code defines abuse as intentionally or recklessly causing or attempting to cause injury, or making another person reasonably apprehensive of imminent serious injury to himself or herself, or to another person.
Harsh Punishments for Domestic Violence
California's penal code imposes harsh penalties if you are convicted of domestic violence. If you are convicted of causing a "traumatic condition" (a broad category defined as any minor or serious internal or external condition caused by force), it is a felony. You face up to a $6,000 fine, imprisonment either in a county jail for up to one year or in a state prison for between two and four years, or both a fine and imprisonment. If you are convicted of a domestic violence battery, you face a fine of up to $2,000, imprisonment in county jail for up to one year, or both. If you have had a previous conviction for a violent crime such as assault with a deadly weapon, battery, or other domestic violence offense, the punishments increase sharply.
Other punishments can include having to participate in domestic abuse counseling and anger management programs and having a temporary or permanent restraining order against you (which can include limiting your contact with your children).
